These terms are an agreement between you and EQCALL PTY LTD (ACN 627 299 736), trading as Startiup ("we", "us"). By signing in or using the Startiup Idea Computer (the "service") you agree to them. If you don't agree, please don't use the service.
1. What the service does
You give the computer an idea name and a short description. It uses artificial intelligence (AI) to build a working prototype of that idea, publishes it at a temporary link for 7 days, and gives you the app's source files to download.
A prototype is a demonstration, not a finished product. It may contain errors, missing features or security weaknesses. Do not use it to handle real customers, real payments or real personal information without having it properly reviewed and finished first.
2. Your account
- You sign in with a link sent to your email. Keep access to your email secure: anyone who can open your login links can use your account.
- You must be at least 18, or have a parent or guardian's permission to use the service.
- You are responsible for everything done through your account.
3. Credits and payment
- The service is paid for with credits. 1 credit costs US$1. Building one idea costs 69 credits, taken from your balance when the build starts.
- Prices are in US dollars. EQCALL PTY LTD is not registered for GST, so no GST is charged.
- Payments are processed by Stripe. We never see or store your full card details.
- If a build does not finish, the 69 credits for it are returned to your balance automatically.
- Credits do not expire. Except where the law requires otherwise (see section 9), credits cannot be exchanged for cash and purchases are not refundable once credits are added to your balance.
4. Your ideas and what you get
- Your idea stays yours. We do not claim ownership of your idea name, description or the source files we give you.
- You give us permission to store and process your idea, and to send it to our service providers (including AI providers), only so far as needed to build, host and deliver your prototype and to keep the service working and safe.
- Subject to these terms and to third-party licences (below), you may use, change and publish the source files you download, for any lawful purpose.
- Generated code often includes open-source components. Those components stay under their own licences, and you are responsible for following them.
5. AI-generated output
Prototypes are created automatically by AI. We do not guarantee that a prototype will be original, error-free, secure, fit for any particular purpose, or free of material that infringes someone else's rights. Similar ideas may produce similar results for other users. Please check the output before you rely on it, use it commercially or show it as your own work.
6. What you must not do
You must not use the service to create or publish anything that is unlawful, deceptive or harmful, including: phishing or fake login pages, copies of real businesses' or people's websites meant to mislead, scams, malware or hacking tools, illegal goods or services, content that infringes intellectual property or privacy rights, sexual content involving minors, or harassment of any person.
Every idea is checked automatically before any credits are taken. We may refuse an idea, stop a build, or take a prototype offline at any time if we reasonably believe it breaks these terms or the law, or if we are required to by law. You must not try to disrupt, overload or get unauthorised access to the service.
7. Live links
- Your prototype is published at a public web address for 7 days. Anyone who has the link can open it.
- Do not put real personal, financial or confidential information into a prototype.
- After 7 days the link goes offline. Your source files stay in your account to download.
8. Service provided "as is"
To the extent permitted by law, the service, the prototypes and the source files are provided "as is" and "as available". We do not promise that the service will always be available, uninterrupted or error-free, or that a build will finish within any particular time. We may change, suspend or stop any part of the service.
9. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Where the law allows us to limit our liability for failing to meet such a guarantee, our liability is limited, at our choice, to supplying the service again or paying the cost of having it supplied again (for example, returning the credits you used).
10. Limits on our liability
To the extent permitted by law:
- we are not liable for any indirect or consequential loss, or for loss of profits, revenue, business, opportunity, goodwill or data, however it arises; and
- our total liability to you for all claims relating to the service is limited to the amount you paid us in the 3 months before the claim arose.
These limits do not apply to liability that cannot be limited by law.
11. Your responsibility
To the extent permitted by law, you agree to cover any loss, damage or cost we suffer because of a claim brought by someone else arising from the ideas you submit, your use of a prototype or the source files, or your breach of these terms or the law, except to the extent the loss was caused by us.
12. Ending your use
You can stop using the service at any time, and you can ask us to close your account. We may suspend or close an account that breaks these terms. If we close your account without you having breached these terms, we will return the value of any unused credits.
13. Changes
We may update these terms from time to time. The date at the top shows the latest version. If a change is significant, we will let you know by email or on the site. Continuing to use the service after a change means you accept the updated terms.
14. Governing law
These terms are governed by the laws of South Australia, Australia. You and we submit to the courts of South Australia and the courts that can hear appeals from them.
